Custom Marketing Programs:  I will design and carry out your program of education-based marketing.  In most cases, I create everything we need to start your program during the first 60 days.  Then I implement your program within 90 days of when we start working together.  I’ll be glad to design the materials you need, then launch your program and carry it out indefinitely.  Or I can design your program and then show you how to carry it out in house.  Often, I can tailor your marketing program to your budget because creating your program is a function of time.  I design and carry out custom marketing programs for fees ranging from $15,000 per month (maximum) to $2,500 per month (minimum).

Writing Services:  I’ll be happy to write just about anything you need:  Educational materials and handouts.  Biographies.  Newsletters.  Brochures.  Web sites.  Home pages.  Response forms.  E-mail signatures.  Intake forms.  News releases.  Feature articles.  By-lined columns.  Author captions.  Seminar outlines and handouts.  Print ads.  Broadcast commercials.  Letters for any purpose.  Direct response materials.  Promotional fliers.  Newspaper inserts.  Single and double post cards.  Audio and video scripts.  And more.  I offer writing services by the project or at $550 per hour.

Consulting Services:   Fees are based on the nature of the assignment and the time required, usually charged at $550 per hour. When you give me the details, I will quote my fee.  I offer services in many areas, including

Telephone Consultations:  I will gladly reserve time for a telephone consultation with you -- or a conference call with your firm.  I will respond to your questions, offer comments and suggestions, and recommend steps you can take to achieve your marketing goals.  I request payment in advance, at the time I write your appointment into my calendar.

Reviews and Evaluations:  I will review and evaluate your current marketing materials, marketing program or web site.  Then I will provide you with a written report in which I identify strengths and weaknesses, and offer comments and specific recommendations.

Troubleshooting:  I will critique your current marketing effort and suggest how you can improve your results.  I will review your marketing message and the methods you use. Plus I will evaluate your strategies to attract qualified inquiries from the prospects you want to reach.  If you wish, I will provide you with a written report.

Proposal Evaluations:  If you plan to hire help with your marketing, I will review the agencies’ proposals and identify their strengths and weaknesses. Then I will provide you with a written report.  This service could save you dozens of migraines, months of wasted time, and tens of thousands of dollars.

Confidential Second Opinions:  If you’ve received marketing recommendations and would like an unbiased, objective point of view, I’ll be glad to help you.  Your marketing program must be based on sound, proven principles.  Plus, while many ideas sound good in theory, they often don’t work in practice.  Over the past 30 years, I’ve made many mistakes -- costly mistakes that I’d like to help you avoid.

Marketing Plans:  I will write a plan that will serve as your marketing road map.  It will give you the specific steps you need to take to reach your objec­tives using my method of education-based market­ing.  My marketing plans are in letter format and usually run five to ten pages in length.  Depending on the level of detail you request, they typically range from $1500 to $4500.

Expert Testimony:  I will help you with marketing-related claims and lawsuits, including bar claims of ethical violations against attorneys, malpractice claims against marketing agencies and consultants, claims against directory publishers, claims against advertising sales representatives, and claims against companies selling marketing products or services.  I base my fees on a number of factors, which I will gladly discuss when the situation arises.

Seminars:  I offer seminars on education-based market­ing to state and local bar associations and lawyer groups.  I can present seminars in person, by video-conference or by telephone.  I base seminar fees primarily on the length of the presentation, the size of the group, the preparation time required, travel time and distance, and the length of time I’m out of the office.  If you’d like me to address your group -- or if you’d like to sponsor my seminar for your members -- please don’t hesi­tate to call.

Payment and Commissions:  I create marketing programs -- and write marketing materials -- specifically for you.  This is why I ask for payment in advance.  I do not accept ad agency commissions from the purchase of advertising because that would be a conflict of interest.  If I buy advertising for you, and if the media outlets offer an ad agency commission, they will usually credit that amount directly to your account.

Outside Services:  I have assembled an experienced group of professionals I depend on for support services.  They include artists, designers, photographers, printers, secretaries and researchers.  If you already have suppliers, I’ll gladly work with them.  Or, you can use my suppliers, if you wish.  I do not mark up outside services, so you can use their services at my cost.  In most cases, they will bill you directly.

(Please note:  These fees are for marketing projects only and do not include services as an expert witness or seminar presentations.)

Fixed Fee Per Month:  Suitable for custom marketing programs and other ongoing arrangements when you want my fees to remain constant from month to month.   Quoted as a fixed fee, with the first month’s fee requested in advance.

Fixed Fee Per Project:  Suitable when we can evaluate the effort required, and when we can define the project’s beginning and end.  Quoted as a fixed fee, with the full fee requested in advance for projects to be completed within 60 days.  For longer projects, I will propose a payment schedule.

Hourly Per Project with a Ceiling:  Suitable when we cannot estimate the effort required, and when the project has a maximum value you don’t want to exceed.

Hourly Per Project:  Suitable when we cannot estimate the effort required, or when the project will continue into the future without a specific end date.

Hourly As Needed:  Suitable for smaller assignments, when a project fee is not practical, or when you prefer hourly billing.
